KOCHI: Dependents of a fisherman shot dead by two Italian marines onboard Enrica Lexie and the fishermen who were on the boat have alleged before the Supreme Court that Indian government and Republic of Italy failed to protect their basic human rights. Criminal liability of the captain and the ship owner has also not been considered, their plea said.
The plea was filed by relatives of deceased Ajeesh Pink and by the other fishermen through advocate Yash Thomas Mannully online in view of Covid-19.
In the plea, the dependents and the fishermen said, “It is submitted that the Government of India and the Italian Republic has not consulted or heard the above named victims while denying their basic human rights under Universal Declaration of Human Rights, 1948 & International Convention on Civil and Political Rights, 1966 and the fundamental rights under the Indian Constitution & European Convention on Human Rights due to the shooting from MT Enrica Lexie by Italian marines on 15-02-2012 while within Indian coastal waters. Further, without any procedure established by law as envisaged under the Indian Constitution, the criminal trial in Crime No. 2 of 2012 of Neendakara Coastal Police Station, Kerala State is being closed without any fair and effective investigation and prosecution.”
